1. LEGAL NOTICE

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the website www.iko-nott.com, operated by CYBELE SAS, a simplified joint-stock company with a capital of €6,000, registered with the Évry Trade and Companies Register under number 882 384 993, with its registered office located at 53 Grande Rue, 91490 Oncy-sur-École. Placing an order implies full and unconditional acceptance of these Terms and Conditions of Sale. CYBELE SAS reserves the right to modify them at any time; the applicable version is the one available online on the date of the order.

2. PRODUCTS

In accordance with Article L. 111-1 of the French Consumer Code, CYBELE SAS presents the Products for sale and their characteristics on the Website. The Customer may review the essential characteristics of the Products they wish to purchase before placing a final order.

Offers for in-stock items presented by CYBELE SAS are valid only while supplies last.

Pre-order offers presented by CYBELE SAS are valid only for a limited time and while supplies last.

Photos depicting the Products are for illustrative purposes only. These photos, like the descriptions accompanying the Products, are not contractually binding.

3. PRICES

The prices listed on the Site are indicated in euros, including tax, and are valid only as of the date the Customer confirms the Order. CYBELE SAS reserves the right to modify these prices at any time without prior notice, provided that Products will be billed based on the rates in effect at the time the Order or Pre-order is placed.

Prices do not include shipping costs, which are billed separately and indicated before the Order or Pre-order is confirmed. Prices include the VAT applicable on the date of the Order or Pre-order, and any change in the applicable VAT rate will be automatically reflected in the prices of the Products listed on the Site. Payment of the full price must be made at the time of the Order or Pre-order. Under no circumstances may the amounts paid be considered as deposits or down payments. These prices are guaranteed subject to typographical or printing errors.

The price of Products shipped outside the European Union and the French overseas departments and territories (DOM-TOM) will be calculated excluding taxes. In this case, the Customer is considered the importer of the Products. If customs duties, import taxes, or other charges are due based on the Products’ destination, these costs are the responsibility of the Customer, who is advised to verify the applicable charges and complete any necessary procedures prior to confirming their Order.

4. PAYMENT

Products are payable in euros on the day the Order is placed.

The Customer may use the following payment methods: credit card (via Stripe), PayPal, and installment payments (via Alma). The Customer’s banking information is not stored by CYBELE SAS. Payment is fully secured by the relevant service providers.

5. ORDER AND PRE-ORDER

Any Order or Pre-order will be confirmed when the Customer clicks the “Place My Order” button.

Confirmation of the Order or Pre-order implies the Customer’s acceptance of the Terms and Conditions and the essential characteristics of the Products.

As soon as the Order or Pre-order is placed, CYBELE SAS will send the Customer a confirmation email summarizing the order (products, prices, product availability, quantity, etc.). To this end, the Customer expressly agrees to the use of email by CYBELE SAS to confirm the contents of their order. In any event, invoices are issued upon order confirmation.

In the case of a Pre-order, any amounts paid in advance by the Customer do not constitute a deposit within the meaning of Article 1590 of the Civil Code.

If the Product is in stock, the Order will be fulfilled no later than 7 days from the day following the day the Customer placed the Order. If the ordered Product is unavailable, particularly due to supplier issues, the Customer will be notified as soon as possible and may cancel the Order. The Customer will then have the option to request an exchange of the Product within fourteen (14) days of receipt or to receive a refund.

The refund will be issued no later than fourteen (14) days following the cancellation of the Order.

6. DELIVERY

6.1 Delivery Address

Delivery is made to the delivery address provided by the Customer, provided that this address is the Customer’s residence or that of any other individual of their choice, if this is clearly specified at the time of the Order or Pre-order. Delivery cannot be made to hotels or P.O. boxes.

When entering their personal information, the Customer must ensure that the required information provided is accurate and complete. In the event of an error in the recipient’s address, CYBELE SAS shall not be held liable for any failure to deliver the Product(s).

6.2 Delivery Times

Delivery times are indicated at the time of the Order. These are approximate times, expressed in business days and corresponding to average processing and delivery times.

The Customer acknowledges that, in the case of a Pre-order, the delivery time will be extended. The estimated delivery time is listed on the product page at the time of purchase and in the order confirmation email. The delivery time depends on the time required and the production volume for all pre-ordered products.

CYBELE SAS cannot be held liable for any consequences resulting from a delivery delay that is not its fault or that is due to a force majeure event.

6.3 Receipt of Products

Delivery is deemed complete upon the carrier’s handover of the Products to the Customer, as recorded by the carrier’s tracking system.

Upon receipt of the Products, the Customer is required to inspect the condition of the packaging and to report any damage to the carrier on the delivery slip, as well as to CYBELE SAS, within three (3) days of receipt by sending an email to hello@iko-nott.com.

The Customer may, upon request, have an invoice sent to the billing address rather than the shipping address.

Shipping costs are displayed before the order is confirmed. In mainland France, shipping is free for purchases of €50 or more via Mondial Relay. In the event of a return or exchange within mainland France, CYBELE SAS will cover the return shipping costs. If the product is non-conforming, return shipping costs are also covered by CYBELE SAS, regardless of the destination.

6.4 Product Warranty

7. STATUTORY WARRANTY

CYBELE SAS is liable for any lack of conformity existing at the time of delivery of the Product, in accordance with Articles L. 217-4 et seq. of the French Consumer Code.

When invoking the statutory warranty of conformity, the Customer:

- has a period of two years from the date of delivery of the Product to take action.

- may choose between repair or replacement of the goods; however, in accordance with Article L. 211-19 of the French Consumer Code, CYBELE may not comply with the Customer’s choice if that choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In such cases, CYBELE is required to proceed, unless it is impossible to do so, with the option not chosen by the Customer.

- is not required to provide proof of the existence of a lack of conformity of the item during the twenty-four months following delivery of the item.

This statutory warranty of conformity applies independently of any commercial warranty that may be provided.

The Customer may decide to invoke the warranty against latent defects in the item sold, as defined in Article 1641 of the Civil Code, which render it unfit for its intended use or which so impair that use that the buyer would not have purchased it, or would have paid only a lower price for it, had they been aware of such defects. In this case, the Customer may choose between rescission of the sale or a reduction in the purchase price in accordance with Article 1644 of the Civil Code.

Any claim arising from redhibitory defects must be brought by the Customer within two years of the discovery of the defect.

8. RIGHT OF WITHDRAWAL

Pursuant to Articles L.221-18 et seq. of the Consumer Code, the Customer has a period of fourteen (14) clear days from the date of delivery of the Order to exercise their right of withdrawal regarding the Order.

This period begins upon the Customer’s receipt of the Products.

The Customer must include with their request to cancel a copy of the invoice or any other document identifying the Order in question and its owner.

Only the Customer identified as such by CYBELE SAS may exercise this right, to the exclusion of any other person, including the recipient of the delivery (for example, in the case of a gift).

9. RETURN AND REFUND POLICY

Any exchange or return must be reported by the Customer to CYBELE SAS via: the returns portal

The Products must be returned by the Customer no later than fourteen (14) days after notifying CYBELE SAS of their decision to withdraw.

The Product must be returned by the Customer in its original packaging in perfect condition (suitable for resale, having been neither worn nor washed) in order to request an exchange or refund.

The shoe box is an integral part of the product and must under no circumstances be used as shipping packaging. All returns must be placed inside separate shipping packaging (cardboard box, bubble wrap envelope, or kraft paper). Any return received with tape, shipping labels, or any markings directly affixed to the shoe box will be considered a damaged product and will not be eligible for a refund.

If the package is lost or damaged during the return process, the cost of the damage is the Customer’s responsibility.

Products that are not returned within the timeframes and under the conditions specified above will not be refunded or exchanged by CYBELE SAS.

In accordance with Article L. 221-24 of the French Commercial Code, Cybele agrees to refund the amounts received for the Order or Pre-order within fourteen (14) days. This period begins upon CYBELE SAS’s receipt of the returned Products.

The refund will be credited to the Customer’s bank account associated with the credit card used to pay for the Order or Pre-order. If you have changed your bank account, please remember to provide your new bank details to your former bank.

10. GOVERNING LAW

These Terms and Conditions are governed by French law. In the event of a dispute or complaint, the Customer shall first contact CYBELE SAS to seek an amicable resolution.

The Customer is informed that any consumer may, free of charge, seek the assistance of a consumer mediator to resolve a dispute with a business amicably. Consumer mediation applies to any domestic or cross-border dispute between a consumer and a business arising from the performance of a contract for the sale of goods or the provision of services.

You may either contact a consumer mediator listed on the consumer mediation website or fill out the automated complaint form to contact a dispute resolution body.

The consumer mediator may accept the request if:

1° The Customer fails to demonstrate that they have previously attempted to resolve the dispute directly with CYBELE SAS by filing a written complaint in accordance with the established procedures;

2° The request is manifestly unfounded or abusive;

3° The dispute has previously been reviewed or is currently under review by another mediator or by a court;

4° The consumer submitted the request to the mediator more than one year after filing a written complaint with CYBELE SAS;

5° The dispute falls outside the mediator’s jurisdiction.

The consumer will be notified by the mediator, within three weeks of receipt of the case file, of the rejection of the mediation request.

If mediation is not pursued, the courts within the jurisdiction of the company’s headquarters shall have jurisdiction.

11. INTELLECTUAL PROPERTY

All elements of the website www.iko-nott.com (text, photographs, visuals, logos, brand names) are the exclusive property of CYBELE SAS and are protected by French intellectual property law. Any reproduction, representation, or use, even partial, without the prior written authorization of CYBELE SAS is strictly prohibited.
